What information can the Court give me regarding my Photo Speed Enforcement notice?

The court will answer any photo speed enforcement questions that involve the court. The court representatives will not offer legal advice. All other photo speed enforcement questions that are non-court related will be referred to the Denver Police Department Photo Enforcement Unit at 720-865-6941.

If you would like to contest the ticket, your appearance in court is necessary. The first step is process service. You can wait until the peace officer personally serves you (there is a minimum additional fee of $35 assessed if you choose this option), or you may appear at 1437 Bannock St., Room 109 between the hours of 8:00 a.m. and 5:00 p.m., Monday – Friday. A picture ID (Driver’s license or state issued Identification card) is required when setting a Final Hearing.

Do I need to be present if I choose to contest my photo speed enforcement citation?

Yes, whether you choose to wait to be served by a peace officer or choose to come in before you are served, you must be present to set your case for a Final Hearing. The listed owner of the vehicle on the notice must appear at 1437 Bannock St., Room 109 between the hours of 8:00 a.m. and 5:00 p.m., Monday – Friday. A picture ID (Driver’s license or state issued Identification card) is required when setting a Final Hearing.

Are there additional costs if I contest my citation in court?

No. Court costs are not assessed if you contest the citation.

Do I need to appear in Court if I am the listed vehicle owner but not the pictured driver?

It is not necessary to appear in court to contest the citation if you are the vehicle owner listed but are not the pictured driver. You may follow the instructions listed on the notice for “Not the pictured driver” and submit the affidavit for “Not the pictured driver” in the envelope provided.

What happens at the Final Hearing?

At the Final Hearing, you, the magistrate and the photo enforcement operator are present. After the evidence and testimony is entered into the court, the magistrate will enter their findings of liable or not liable. If you are found liable, you are required to pay the fine amount.

Can I plea bargain the fine amount or the points on my photo speed enforcement citation?

No. The fine will not be reduced, and the city attorney cannot reduce points because points are not assessed against your driver's license on photo speed enforcement citations.

Once I set a final hearing, do I have any options to resolve the case?

Once you have pled not guilty and have scheduled your case for a final hearing, you must appear or pay the fine amount before your final hearing date. The payment MUST be processed before the final hearing date.
