PENALTIES
 

Unlike “regular” traffic cases, photo speed enforcement citations have a flat fine associated with them and court costs cannot be assessed under any circumstances. Additionally, photo speed enforcement cases are zero point violations that are never reported to the Department of Motor Vehicles. The result of this is that no matter how many photo speed enforcement citations a person receives, it will never affect their right to drive in Colorado; nor should it affect the individual’s automobile insurance rates. The statutory fine for photo speed enforcement violations is $40. For red light violations, the statutory fine is $75. If any photo speed enforcement violation occurs in a school zone, the law allows for the fine to double.

ENFORCEMENT
 

By law, a warrant can never issue and a person can never be arrested for outstanding photo speed enforcement citations. In order to enforce outstanding citations where a person failed to pay, or if the person set a court date and failed to appear, the city is authorized to immobilize the vehicle via a “boot.” Once the boot is placed on the vehicle, the person must pay their full fines and costs, any additional service fees and a boot fee. Typically the minimum due at the time of booting is $120. If the fees are not paid within 72 hours, the city also charges a towing fee and a daily storage fee on the vehicle.
