Restaurant
Retail food establishment shall mean a retail operation that stores, prepares, or packages food for sale for human consumption or serves or otherwise provides food for sale for human consumption to consumers directly, or indirectly through a delivery service, whether such food is consumed on or off the premises, unless such retail operation is excluded from regulation and licensing by section 23-1 of this chapter 23.

Retail food establishments shall pay the following fees:

Application fee:
Restaurants with a seating capacity of 1 to 25 patrons . . . 150.00
Restaurants with a seating capacity of 26 to 100 patrons . . . 200.00
Restaurants with a seating capacity of 101 to 500 patrons . . . 250.00
Restaurants with a seating capacity of more than 500 patrons . . . 300.00

Restaurant license fees, per year:
Restaurants with a seating capacity of 1 to 25 patrons . . . $125.00
Restaurants with a seating capacity of 26 to 100 patrons . . . 200.00
Restaurants with a seating capacity of 101 to 500 patrons . . . 300.00
Restaurants with a seating capacity of more than 500 patrons . . . 400.00
Plus $50.00 per outlet

Restaurant Stand up / Push Cart
Restaurant-type operation located on premises where the primary business is not the operation of a restaurant, including the offering for sale of food or drink for consumption on or off the premises, stand-up counters, prepared food items sold with the aid of a pushcart, wagon, carriage or vehicle of any kind or description, and similar food or drink sellers who do not provide seating arrangements for patrons.

Pushcart shall mean a non-self propelled vehicle limited to serving commissary prepared or prepackaged food and non-potentially hazardous food, unless the equipment is commercially designed and approved to handle food preparation and service.

Restaurant Mobile

Mobile retail food establishment shall mean a retail food establishment that reports to and operates from a commissary and is readily moveable, is a motorized wheeled vehicle, or a towed wheeled vehicle designed and equipped to serve food.

Fire, Health, Zoning approval is needed if the vehicle will be stored in the City and County of Denver.

Application fee:
Restaurant Mobile: $200.00

License fee:
Restaurant Mobile: $125.00

Restaurant Temporary
Temporary retail food establishment shall mean a retail food establishment, other than a licensed mobile retail food establishment or pushcart, that is not intended to be permanent and that operates at a fixed location for a period of time of not more than fourteen (14) consecutive days in conjunction with a single event or celebration.
 


Notice:   Effective the 2nd of March 2009 applications for an annual Temporary Restaurant License must include a list of all events in which the applicant will participate during the year. The list must be submitted at the time of application for the annual Temporary Restaurant LIcense.
 
The fees for each event remain the same, $10.00 per day for the first five (5) days of each event.
 
Additional events may be added during the year the by filing an addendum to the original application and paying the additional event fees. The annual Temporary Restaurant LIcense may only be used on the event dates provided in the appication or addendum.
 
Violations may result in suspension or revocation of the annual Temporary Restaurant License, and any violations will be considered at license renewal.

Fees
Temporary retail food establishment license fees, per year, shall be one hundred dollars ($100.00) plus $10.00 per day for the first five days of each event. Temporary retail food establishments shall not pay application fees.
