I paid my citation why did I receive a second notice?
-
After the first notice of violation is mailed if payment is not received and credited to the citation, a second reminder notice is sent. Often times the second notice and payment pass each other in the mail. If your payment is rejected you will receive a letter from the City indicating the reason for the rejection.
I paid my citation or I plead not guilty and was still personally served?
-
If no response is received after the second notice of violation a penalty assessment notice is printed and sent to the Sheriff's Office for personal service. Payment or cancellation of the notice may occur after the notice has been sent to the Sheriffs Office.
-
All returned personally served citations are reviewed by an employee of the Denver Police Department. If payment was received and credited prior to the personal service or the notice was otherwise cancelled (not the pictured driver, plate misread, etc.), the personal service fee will be cancelled.
What are the fines and costs for Photo Enforcement Citations?
-
The fine for a Photo Speed violation in a residential area or street bordering a park is $40.00.
-
The fine for a Photo Speed violation in a school zone is doubled to $80.00.
-
The fine for a Photo Red Light violation is $75.00
-
If personal service of a Penalty Assessment Notice is required due to lack of response from the registered owner of the vehicle, an additional fee covering the actual cost of service will be added. The minimum addition fee for personal service is $37.00; which is added to the fine amount due for the photo enforcement violation. This fee may be greater if the actual cost of personal service is greater.
Will I receive any points on my driving record for a photo speed or photo red light violation?
What happens if I ignore the Notice of Violation?
-
Failure to respond to the notice will result in a Penalty Assessment Notice being authorized by the Denver Police Department. This Penalty Assessment Notice will be personally served by a uniformed Sherriff. If personal service is effected an additional charge of at least $37.00 will be added to the violation costs. This fee may be more if the cost of personal service is more than $37.00. If a Penalty Assessment Notice is served your appearance in court will be required. This is similar to a police officer stopping you and handing you a traffic ticket.
-
The respond by date is listed on the served Penalty Assessment Notice. This respond by date is your arraignment date. You will need to pay the fine and costs including the personal service fee, submit a not pictured driver affidavit, nominate the driver (not required to) or plead not guilty by this respond by date.
What if I am not the person driving the vehicle at the time of the violation?
Do I have to nominate the person driving the vehicle?
What happens after I submit the Not Pictured Driver Affidavit?
-
The affidavit and required documentation is reviewed by a Denver Police Department employee. If is accepted, the case against you will be dismissed. If the Not Pictured Driver Affidavit is not accepted, the Notice of Violation will remain in your name. If you set your case for final hearing and your not pictured driver is not accepted, a Photo Enforcement Agent will appear on the day of final hearing.
What happens if I nominate another person?
-
The Nomination Affidavit information is reviewed by a Denver Police Department employee. If is accepted, the notice of violation against you will be cancelled and placed in the name of the person nominated.
-
If a Penalty Assessment Notice was served and/or filed in the Denver County Court, the Denver Police Department will submit a motion via our City Attorney to dismiss the case against you and the Notice of Violation or Penalty Assessment Notice will be issued to the individual you nominated.
-
If the Nomination Affidavit is not accepted, the Notice of Violation will remain in your name. If you set your case for final hearing and your nomination is not accepted, a Photo Enforcement Agent will appear on the day of final hearing.
