Retail Marijuana Licenses

Retail marijuana applications will be accepted Monday-Friday 8:00a.m.- 4:00 p.m

In order to be eligible for a Retail Marijuana License, an applicant must have had or purchased a medical marijuana business that had been operating in good standing as a on or before Oct. 1, 2013. An applicant must possess a valid City and State medical marijuana business license at the time of application.

Please bring your completed application package and all required documents when you come to the Department of Excise & Licenses. Our staff can answer all of your questions about the licensing process, but cannot provide legal or business advice. We recommend that you enlist the services of professional lawyers and contractors to review your application and construction plans.

Retail marijuana businesses must be licensed by both the City of Denver’s Department of Excise & Licenses and the State of Colorado’s Marijuana Enforcement Division.

  • Denver Excise & Licenses issues four types of retail marijuana licenses:
  • Retail Marijuana Store
  • Retail Marijuana Optional Premises Cultivation License
  • Retail Marijuana Infused Products Manufacturing License
  • Retail Marijuana Testing Facility

Applying for a New Business License

Businesses wishing to obtain a retail marijuana business license must follow these licensing steps.

1. Submit a completed application along with all supporting documents and application fees to the State of Colorado’s Marijuana Enforcement Division.

2. Submit a completed application along with all supporting documents and application fees to the City of Denver’s Department of Excise & Licenses.

3. Retail marijuana store applicants will have a public hearing coordinated by Denver Excise & Licenses.

4. The business will be issued an inspection card that will need to be signed by the following City of Denver agencies: 

  • Environmental Health: 720-865-5401
  • Denver Fire Department: 720-913-3409
  • Community Planning & Development - Neighborhood Inspections: 311
  • Community Planning & Development - Building Inspections: 720-865-2700
  • Excise & Licenses - last inspection once others are complete: 720-865-2756

5. Return completed inspection card to Excise & Licenses. The department will check to make sure that the State of Colorado’s Marijuana Enforcement Division has issued the applicant a state license, and then a  city license will be issued.

New applicants for retail marijuana stores, cultivation facilities, and infused product manufacturing facilities will need to pay a $250 application fee. Applicants applying for a retail marijuana testing facility license will need to pay a $1,000 application fee. The application fee check should be made payable to the “Manager of Finance ” and should be submitted to the State of Colorado’s Marijuana Enforcement Division along with a completed state license application.

New applicants will also need to pay a $5,000 license fee. This check should be made payable to the “Manager of Finance” and should be submitted to Denver Excise & Licenses along with a completed city license application.

When applying for a city license, applicants will need to submit the above application form along with following supporting documents:

  • Statement of Trade Name (if applicable) 
  • Copy of Zoning Use Permit from the City and County of Denver
  • A floor plan of the current licensed premise and a floor plan of the proposed changes to the licensed premise, drawn to scale on 8-1/2” x 11” paper, showing the layout of the establishment and the principal uses of each section of the floor area. Please include dimensions, security cameras, and separate pages for each floor level. The floor plan must be stamped by the City and County of Denver Zoning Department during its zoning permit review.
  • Copy of Burglar Alarm Permit & Monitoring Contract
  • Copy of City & State Sales Tax License (STORE ONLY) 
  • Copy of State License 
  • Lease or Deed (If leased, you must attach the written consent of owner to lease property to a marijuana establishment)
  • A security plan indicating how the business intends to comply with the requirements related to monitoring and securing the licensed premises as required by law
  • Affidavit of Lawful Presence for each owner 
  • Bylaws, Operation, Partnership Agreement (as applicable)
  • Surety Bond (STORE ONLY)
  • Distance Wavier (STORE ONLY)
  • Marijuana License Application Acknowledgment Form (STORE ONLY) – to be completed at Denver Excise & Licenses
  • Copy of Valid ID for each owner (Colorado Driver’s License or Colorado ID card) 
  • A description of products and services to be provided by the establishment, including an indication of whether the establishment proposes to engage in the retail sale of food for human consumption
  • An area map, drawn to scale on 8-1/2 x 11” paper, indicating within a radius of one-quarter mile from boundaries of property upon which establishment is located, the proximity of the property to any school or child care establishment; to any other marijuana center or store, drug treatment facility, or to any residential zone district (STORE ONLY)

Renew a Business License

City marijuana business licenses are valid for one year. Businesses are required to renew their city license within 60 days of its expiration date.

To renew a city-issued retail marijuana business license, follow these steps:

1. Complete the Retail Marijuana Renewal form.

2. Bring the Retail Marijuana Renewal Form along with all supporting documents and the required annual license fee to Denver Excise & Licenses.

3. You will be issued a new license.

Please Note: retail marijuana businesses are also required to renew their state-issued license on an annual basis.

Renewal applicants will need to pay a $5,000 annual license fee at the time of renewal. Checks should be made payable to the “Manager of Finance” and should be submitted to Denver Excise & Licenses along with their completed city license renewal form.

New applicants will need to completely fill out the:

When renewing a city license, applicants will need to submit the above renewal form along with following supporting documents:

  • Copy of Burglar Alarm Permit & Monitoring Contract
  • Lease or Deed (If leased, you must attach the written consent of owner to lease property to a marijuana establishment)
  • Bylaws, Operation, Partnership Agreement (as applicable)
  • Retail Marijuana Surety Bond (STORE ONLY)
  • Secretary of State Certificate of Good Standing
  • Copy of Valid ID for each owner (Colorado Driver’s License or Colorado ID card)
  • Copy of State License


Transfer of Ownership

Any time a retail marijuana business has a change in officers, directors, general partners, managing members, stockholders, partners, or members, the business must file for a Transfer of Ownership with the City of Denver's Department of Excise and Licenses.

To file a Transfer of Ownership for a city-issued marijuana business license, follow the steps below:

1. Complete the Retail Marijuana Business Transfer of Ownership form.

2. Bring the Retail Marijuana Business Transfer of Ownership form along with all supporting documents and the required Transfer of Ownership fee to Denver Excise & Licenses.


Please Note: retail marijuana businesses are also required to file a Transfer of Ownership with the State of Colorado’s Marijuana Enforcement Division.

The fee for a Retail Marijuana Business Transfer of Ownership is $100. Checks should be made payable to the “Manager of Finance” and should be submitted to Denver Excise & Licenses along with their completed Retail Marijuana Transfer of Ownership form.

Businesses will need to fill out completely the:

When transferring ownership, applicants will need to submit the above completed Transfer of Ownership form along with following supporting documents:

  • Secretary of State Statement of Trade Name (if applicable)
  • Copy of State License
  • Copy of Zoning Use Permit from the City and County of Denver
  • Copy of Burglar Alarm Permit & Monitoring Contract
  • Copy of City & State Sales Tax License (STORE ONLY)
  • Lease or Deed (If leased, you must attach the written consent of owner to lease property to a marijuana establishment)
  • Affidavit of Lawful Presence for each owner
  • Bylaws, Operation, Partnership Agreement (as applicable)
  • Surety Bond (STORE ONLY)
  • Secretary of State Certificate of Good Standing
  • Copy of Valid ID for each owner (Colorado Driver’s License or Colorado ID card) 
  • Purchasing Agreement

Transfer of Location

Anytime a retail marijuana business wishes to change the location of their establishment they must file for a Transfer of Location with the City of Denver's Department of Excise and Licenses. 

To file a Transfer of Location for a retail marijuana business, follow the steps below:

  1. 1. Submit a completed Retail Marijuana Business Transfer of Location form along with all supporting documents and application fee to the City of Denver's Department of Excise and Licenses.

  2. 2. Retail marijuana store applicants will have a public hearing coordinated by the Department of Excise and Licenses.

  3. 3. The business will be issued an inspection card that will need to be signed by the following City of Denver agencies:
  • Environmental Health: 720-865-5401
  • Denver Fire Department: 720-913-3409
  • Community Planning & Development - Neighborhood Inspections: 311
  • Community Planning & Development - Building Inspections
  • Denver Excise and Licenses - last inspection once others are complete: 720-865-2756
  1. 4. Applicant must return completed inspection card to Excise and Licenses.

  2. 5. Excise and Licenses will then issue a retail marijuana business license for the licensee at the new location.

  3. 6. The business may then begin to operate at the new location once it has obtained the new City and State licenses.

Please note - retail marijuana businesses are also required to file a Transfer of Location with the State of Colorado's Marijuana Division.

The fee for a Retail Marijuana Business Transfer of Location is $750. Checks should be made payable to the “Manager of Finance” and should be submitted to Denver Excise & Licenses along with their completed Retail Marijuana Transfer of Location form.

Businesses will need to fill out completely the:

When transferring ownership, applicants will need to submit the above completed Retail Marijuana Business Transfer of Ownership form along with following supporting documents:

  • Copy of State License
  • Copy of Zoning Use Permit for the new facility from the City and County of Denver
  • A floor plan of the current licensed premise and a floor plan of the proposed changes to the licensed premise, drawn to scale on 8-1/2” x 11” paper, showing the layout of the establishment and the principal uses of each section of the floor area. Please include dimensions, security cameras, and separate pages for each floor level. The floor plan must be stamped by the City & County of Denver Zoning Department during its zoning permit review.
  • Copy of Burglar Alarm Permit & Monitoring Contract
  • Lease or Deed (If leased, you must attach the written consent of owner to lease property to a marijuana establishment)

Modification of Premises

Anytime a retail marijuana business wishes to modify their premises they must file for a Modification of Premise with Denver Excise & Licenses.

To file for a Modification of Premise for a retail marijuana business, follow the steps below:

1. Submit a completed Retail Marijuana Business Modification of Premise form along with all supporting documents and application fee to Denver Excise & Licenses.

2. The business will be issued an inspection card that will need to be signed by the following City of Denver agencies:


  • Environmental Health: 720-865-5401
  • Denver Fire Department: 720-913-3409
  • Community Planning & Development - Neighborhood Inspections: 311
  • Community Planning & Development - Building Inspections: 720-865-2700
  • Excise & Licenses - last inspection once others are complete: 720-865-2746

3. Applicant must return completed inspection card to Denver Excise & Licenses.

4. Excise & Licenses will then approve the Modification of Premise and make a note of the modification in the licensee’s business file.

Please Note - retail marijuana businesses are also required to file for a Modification of Premises with the State of Colorado’s Marijuana Enforcement Division.

The fee for a Retail Marijuana Modification of Premises is $150. Checks should be made payable to the “Manager of Finance” and should be submitted to Denver Excise & Licenses along with their completed Retail Marijuana Modification of Premises form.

Businesses will need to fill out completely the:

When modifying a premise, applicants will need to submit the above completed Retail Marijuana Business Modification of Premises form along with following supporting documents:
  • Copy of Zoning Use Permit from the City and County of Denver 
  • A floor plan of the current licensed premise and a floor plan of the proposed changes to the licensed premise, drawn to scale on 8-1/2” x 11” paper, showing the layout of the establishment and the principal uses of each section of the floor area.
