Purchasing Ordinance

The City & County of Denver is pleased to announce that on February 19, 2014, Ordinance No. CB14-0039 was signed into law by Mayor Michael B. Hancock for the City & County of Denver. The Ordinance will control continued efforts of nondiscrimination in City procurement contracts and will expand opportunities for minority and woman-owned businesses (M/WBEs) and small business enterprises (SBEs) in select procurement industries. This Ordinance goes into effect April 1, 2014. 

The Purchasing Ordinance establishes a comprehensive plan to address disparities that exist in the City’s contracting process and marketplace by opening up new procurement opportunities. The 2013 Disparity Study commissioned by the City found evidence of impediments to the growth of M/WBEs and underutilization of those businesses in select procurement industries. The Purchasing Ordinance creates programs tailored to expand M/WBE and SBE competition within these industries.

The Ordinance will apply only to the following categories of goods and services:

Goods:

  • Electronic parts and equipment
  • Office equipment
  • Machinery, equipment and supplies
  • Electrical and industrial equipment (including parts and supplies)
  • Communication equipment


Services:

  • Building management and maintenance services (including janitorial services)
  • Parking services
  • Security services
  • Maintenance and repair services including landscaping
  • Communication equipment related services
  • General business services (consisting of staffing, interpretation, graphic design, printing and photocopying, transportation, and courier delivery)


City departments and agencies will be working in conjunction with the Office of Economic Development (OED’s) Division of Small Business Opportunity (DSBO) on procurements affected by the ordinance. DSBO will administer the Ordinance Program, including all certification and compliance required by the Ordinance.

A vendor must be certified by DSBO to be eligible to participate in the M/W/SBE programs under this ordinance. Firms interested in certification may find information and application information in the Applying, Renewing, or Workcode Additions section.
