Forms and Fees

Please note that if you simply fax, mail, or email your application, you do not have a hearing date and do not have a case filed with the Board of Adjustment.  Filing fees must be paid before your case is officially filed with our office. 

If you are filing your case in person, we will send you to the cashier to pay the filing fee.  If you are filing remotely, we will have the cashier get in touch with you to obtain payment.

NOTE:  At this time all cases must be filed remotely as all staff are working from home.


The cashier accepts Visa, MasterCard and Discover Card, Cash and personal checks.  Checks must be made payable to "Manager of Finance".  

Please note that the Cashier closes at 4:30 and payment must be made before closing of their office.

Online Forms

Applications

Application forms available for download. Please complete and submit to the office of the Board with the appropriate filing fee to begin a zoning appeal.

Please note that as of this date, you cannot fill out the pdf version of the application online. You also cannot fax the form into the office since you will need to bring your payment in person. Please fill the form out by hand and bring it into the office until further notice.

It is also possible to have your initial filing submitted by mail. Please contact our staff about this process.

The Application can either be printed out and completed by hand, or you can type directly onto the form and print it from your computer. When the application is completed you can either file in person at the office of the Board, or via the postal service. Please have the application, the denial or order you are appealing, and the filing fee together.

  • Administrative Review (3rd Party): Use this form ONLY if you are a 3rd Party (non-landowner) appealing a Zoning Action by the City and county of Denver.
  • Standard Application: Use this form to appeal either a Denial of a Permit or an Order to Cease and Desist issued from the City and County of Denver.
  • ZPSE ApplicationUse this form for Zoning Permit with a special exception review under DZC 12.4.9

Power of Attorney

A properly executed Power of Attorney form is required if all landowners of a property cannot attend a hearing, if the property is owned by a corporation, or is a unit within a condominium development.

  • Individual: For an individual acting on behalf of another individual in accordance with the Board's Restated rules of Procedure.
  • Co-Owner: For a co-owner of property to act on behalf of another co-owner in accordance with the Board's Restated Rules of Procedure.
  • Corporate: For an individual acting on behalf of a Corporation, Company, Association, or Partnership in accordance with the Board's Restated Rules of Procedure.
  • CondominiumFor an individual acting on behalf of a Condominium/Homeowners Association in accordance with the Board's Restated Rules of Procedure.

Filing Fees

The following fees are being charged under 12.3.3.4.B., Denver Zoning Code:

  1. $100.00: For the following a one hundred dollar fee shall be charged.
    1. Enclosures of balconies of individual units of multiple unit dwellings;
    2. Special Exceptions for the keeping of animals only;
    3. Six Month Delay of Enforcement under Section 12.2.6.7. from cease and desist orders from Neighborhood Inspection Services for violations not eligible for Variance or Special Exception, including inoperable, dismantled or other non-permitted vehicles, trash or junk on the property, unpaved or unscreened parking, and unrelated persons.
  2. $150.00: For the following a one hundred fifty dollar fee shall be charged.
    1. Variances for minor construction including fences and detached sheds;
    2. Variances for excess number of vehicles, oversized vehicles such as overlength recreational vehicles, and the location of detached campers, trailers and boats;
    3. Variances for signage (excluding off-premises signs);
    4. Six Month Delay of Enforcement under Section 12.2.6.7. for cease and desist orders from Neighborhood Inspection Services for violations filed under Categories 2.a. through 2.c.
  3. $200.00: For the following a fee of two hundred dollars shall be charged.
    1. Variances for major construction including residential, commercial and industrial buildings, additions to these structures, second use by right structures or ADUs, and garages;
    2. Variances from provisions or conditions of approved landscaping plans (excluding the requirement to provide landscaping);
    3. Six Month Delay of Enforcement under Section 12.2.6.7. from cease and desist orders from Neighborhood Inspection Services for violations filed under Categories 3.a. and 3.b.;
    4. Stay of Effective Date of Orders from cease and desist orders from Neighborhood Inspection Services for the operation of excess dwelling units, including second use by right structures.
  4. $300.00: For the following a fee of three hundred dollars shall be charged.
    1. Special Exceptions (use categories as determined by Zoning Code and Community Planning);
    2. Variances for violations created by zone lot amendments;
    3. Six Month Delay of Enforcement under Section 12.2.6.7. from cease and desist orders from Neighborhood Inspection Services for violations filed under Categories 4.a. and 4.b.;
  5. $400.00:
    1. Appeal of Administrative Decision under Zoning Code by Manager or staff of Community Planning, including all third party appeals of such decisions;
    2. Six Month Delay of Enforcement under Section 12.2.6.7. from cease and desist orders from Neighborhood Inspection Services for violations filed under Category 4.a.;
       

Permit Penalty Fee:   A fifty dollar ($50.00) fee will be assessed on appeals from orders when the applicant has taken action or done construction prior to obtaining the required zoning permit.
